Administrative History

These papers were collected by Mr. Justice Thomas Cromwell during his research and development work with three different but related bodies.

Mr. Cromwell (as he then was) was the Research Director and Project Manager for the Canadian Bar Association (CBA) Task Force on Court Reform. The Task Force was created in 1989 to study various issues relating to court reform in Canada, and in particular the usefulness of establishing a single criminal court and a single civil court. The Task Force carried out comprehensive research on the state of court reform in Canada, the United Kingdom and the United States and met with members of the Bar, the judiciary, government and public interest groups to discuss court reform issues. In the course of the research additional issues of court management and administration as well as the importance of public confidence in the court system arose and became part of the report. Background and Discussion papers were prepared before the final report - the CBA Task Force Report on Court Reform in Canada - was published in August 1991.

In 1995 Cromwell was asked by the CBA's Systems of Civil Justice Task Force to contribute a paper to their "Civil Justice: Reform for the 21st Century" conference held in February 1996. The role of this Task Force was to "inquire into the state of the civil justice system on a national basis and to develop strategies and mechanisms to facilitate modernization of the justice system so that it is better able to meet the current and future needs of Canadians" (from the Forward to the Systems of Civil Justice Task Force Report). The paper he wrote and presented was called "Dispute Resolution in the 21st Century".

The Systems of Civil Justice Task Force Report (August 1996) proposed 53 recommendations. In the autumn of 1996 the national Implementation Committee was formed to carry out these recommendations and Cromwell sat as a Chair of this committee until he was appointed to the Nova Scotia Court of Appeal in August 1997. One of the recommendations made was the establishment of an independent organization to encourage participation from all groups involved in civil justice reform and to facilitate the exchange of information and experience in civil justice reform. In 1998 the Canadian Forum on Civil Justice was established, which is where the Thomas Cromwell Papers now reside.


Scope and Contents

The fonds, or collection, consists of a variety of textual materials collected by Cromwell in the course of his research for the organizations described in the Administrative History, covering court and civil justice reform issues in Canada, the United Kingdom, the United States and Australia. They include periodical articles, reports, conference proceedings, unpublished papers, and a limited amount of correspondence. The papers date from 1972 - 1997, the bulk having been collected by Mr. Cromwell between 1990 and 1997.

Arrangement

The records arrived in 4 boxes, and have been arranged according to research activity where possible, and topical groups otherwise. A general research category is supplied for materials of a broader character. Correspondence has been separated physically from the items, and has been noted in the individual item level descriptions. Correspondence is located in Thomas Cromwell Papers Archive Box 1 (folders 1-6). The remainder of the materials is either on the library's shelves or in the library's hanging files.
